Court Rejects Governor’s Argument That Legislature Can Defeat The Public Trust

In one of the Western states most severely affected by climate change, the Arizona Court of Appeals has just ruled that the atmosphere may be an asset of the public trust, but that Jaime Lynn Butler, a 12-year old native of the Navajo Nation, did not assert adequate grounds for it to decide whether Governor Jan Brewer and other state officials violated the Public Trust Doctrine in failing to control greenhouse gas emissions in Arizona.

Since 1973, the San Juan Coal Company has dumped more than 40 million tons of coal combustion waste containing pollutants like arsenic, lead and mercury into massive unlined pits at the San Juan Mine, about 10 miles west of Farmington. The coal combustion waste disposed of at the mine comes from the nearby San Juan Generating Station, and includes various forms of ash as well as sludge from the scrubbers that remove air pollutants from the power plant exhaust.

A federal court in Denver told the Public Service Co. of New Mexico on Thursday it must install equipment to reduce significantly the 16,000 tons a year of haze and ozone and nitrogen pollution produced by the smokestacks at the San Juan Generating Station near Farmington.
